Terms and Conditions

Thank you for using Yugo, a mobile and web application operated in Canada and designed to enhance the experience of events, bars, and festivals. By accessing or using the application, you agree to these Terms and Conditions (the "Terms").

1. Definitions

Yugo: Yugo Solutions Inc. and its affiliates.
User: any person who accesses or uses the Yugo application.
When using the web application, certain features may be limited.
Personal Information: any information that makes it possible to identify an individual, within the meaning of Québec's Act respecting the protection of personal information in the private sector (Law 25).

2. Eligibility and User Responsibilities

You must be at least 18 years old or have the authorization of a parent or legal guardian.
You may use certain Yugo features without creating a user account, including for one-time orders.
When using the web application, certain features may be limited.
When creating an account, you agree to provide accurate, complete, and up-to-date information.
You are responsible for maintaining the confidentiality of your credentials and for all activities carried out under your account.

3. Acceptable Use of Services

Yugo provides a software application that enables the transmission of orders and notifications.
The physical service (preparation, accuracy, delivery of products, and service by bar or event staff) is provided exclusively by the partner establishment.
Yugo does not participate in the preparation of orders and cannot be held responsible for human errors, service errors, or products provided by the establishment (e.g., incorrect orders, inventory shortages).
Yugo grants you a limited, personal, non-exclusive, and non-transferable license to use the application.
It is prohibited to use Yugo for illegal, fraudulent, or unlawful purposes.
Any attempt to bypass security measures or gain unauthorized access is strictly prohibited.

4. Intellectual Property

All content, software, interfaces, trademarks, and features remain the exclusive property of Yugo.
No intellectual property rights are transferred to the user.

5. Payments and Third-Party Services

Payments are processed by third-party providers that comply with applicable security standards (e.g., PCI-DSS).
Yugo does not store complete payment card information.

6. Collection and Use of Personal Information

Yugo collects only the personal information necessary to enable order placement and tracking, payment management and confirmations, service-related notifications, improvement of performance and user experience, and the production of aggregated and anonymized statistics.
Depending on the method of use (with or without account creation), collected information may include identity data (e.g., email address voluntarily provided), transactional data, usage data, and, where the user consents, approximate location data.
Personal information is collected with explicit, clear, and free consent, except where the law permits collection without consent.
Consent is requested by purpose and may be withdrawn at any time, subject to legal or contractual obligations.
Personal information is retained only for as long as necessary to fulfill the purposes for which it was collected, after which it is securely destroyed or anonymized.
In accordance with Law 25, users have, among other rights, the right to access, rectify, port, and, where applicable, delete their personal information.
Any request relating to personal information may be addressed to the person responsible for the protection of personal information (see section 10).

7. Security Measures

Yugo implements reasonable administrative, technical, and physical measures to protect your information.
Despite these measures, no system is completely secure, and Yugo cannot guarantee absolute security.

8. Limitation of Liability

Yugo is provided "as is," without any express or implied warranties.
Yugo cannot be held liable for service interruptions, data loss, Internet connectivity issues, or acts of third parties.

9. Changes to the Terms

Yugo may modify these Terms at any time.
Material changes will be communicated to users.
Continued use of the service constitutes acceptance of the modified Terms.

10. Person Responsible for the Protection of Personal Information

In accordance with Law 25, Yugo has designated a person responsible for the protection of personal information.

11. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in the Province of Québec and the applicable federal laws of Canada.
Any dispute shall be submitted to the competent courts of the judicial district of Québec.
